HOUGH, District Judge.

The plaintiff, a corporation, was organized for, and is in the business of, generating and supplying electricity to the public for light, heat, and power purposes, and in connection with that business is chartered to hold property and acquire and hold leases and contracts for water to be used in the generation of electricity through hydroelectric power plants. It holds by assignment and under its charter power owns certain leases and grants from the state providing for the use of surplus water from the Miami & Erie Canal.
