MEMORANDUM REGARDING DEFENDANT’S MOTION FOR SUMMARY JUDGMENT (Docket No. 20)
PONSOR, District Judge.
I. INTRODUCTION
Plaintiff Daniel Milesi (“Milesi”) and his wife Sandra Milesi have asserted a claim under the Federal Tort Claims Act (FTCA), 28 U.S.C. §§ 2671-2680, alleging that the Government’s negligent maintenance of a hydraulic lift at the United States Post Office in Lanesboro, Massachusetts resulted in injury to Milesi. The Government has moved for summary judgment pursuant to Fed.R.Civ.P. 56(c). For the reasons set forth below, the defendant’s Motion for Summary Judgment will be denied.
