Girard ¡¡ST. Whitney and James V. Geraghty were stockbrokers in the city of ¡New York, doing business under the firm name and style of Whitney & Kitchen. On January 16, 1908, the firm made a general assignment for the benefit of its” creditors, without preference, to Bayard L. Peck, and on January •2.5, 1908, the members of . the firm made individual general assignments, .without preferehce, to the same person, who duly qualified as assignee under all three assignments on January 17, 1908, February 24, .1908, and March 25, 1908, respectively.
