Appeal by the plaintiff, the Merchants’ National Bank, of Norwich, Connecticut, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 21st day of January, 1896, making Horace F. Hutchinson, as assignee for the benefit ,of creditors of George Hagemeyer and another, a party defendant in the action, and directing that the summons and complaint be amended by including said party as such assignee as a defendant. The application was made upon the petition of the assignee.

This is an appeal from an order made at the Special Term, by which" the assignee for the benefit of creditors of the defendants Hagemeyer was permitted, on his own petition, to be made a defendant, and an amendment of the summons and complaint by including such" assignee as a defendant on the record was directed. The action is upon á promissory note made by the defendants Hagemeyer as ■partners under their firm name of George Hagemeyer & Son, and *54a judgment is also asked against one Chew, an indorser.
