WATKINS, District Judge.

The issues of both law and fact in the above-styled actions are so closely related that they may properly be, and for the sake of brevity will be, disposed of in one opinion. The decision has been delayed, first awaiting the production of briefs, and later because of certain cases known to be pending in the courts of last resort, the decisions of which it was thought might be conclusive of the issues here involved.
