PHELPS, J.—

It affords me great pleasure to comply with the request made by both counsel at the time the court gave its reasons for overruling the demurrer in this case on late Saturday, that the *484court’s opinion should be put in some more tangible form, inasmuch as it was suggested the question was one of considerable importance to a number of persons and institutions not connected with this particular case.
