SULLIVAN, J.

Petitioners seek a writ of mandate to compel respondent superior court to permit them to prosecute a pending action against real parties in interest without filing an undertaking for costs as prescribed by Government Code sections 947 and 951. Petitioners contend that these statutes violate the due process clauses of the Fifth and Fourteenth Amendments to the United States Constitution and article I, sections 7 and 15, of the California Constitution.
