Motion by the plaintiff, Jennie S. Moren, for a new trial upon a case containing exceptions, ordered to be heard at the Appellate Division in the first instance, upon the dismissal of the complaint by direction of the court at the close of plaintiff’s case upon a trial before the court and jury at the Kings County Trial Term in October, 1913.

Carr, J.:
When this action came on for trial a motion was made at the close of the plaintiff’s proof to dismiss the complaint on the ground that the action was brought prematurely. An order was made at the Trial Term dismissing the complaint, but directing the plaintiff’s exceptions to be heard before this court in the first instance, and suspending the entry of judgment in the meantime.
