New York Court of Common Pleas
This action was brought upon a bond executed to the Fire Department of the city of New York, in the penal sum of $1,000, by the defendant, James Wright, as principal, and by the other defendants as sureties. It was delivered to the treasurer of the plaintiffs in May, 1849, pursuant to the act passed on the 30th of March of that year, “ to amend the acts in relation to insurances on property in this state, made by individuals and associations unauthorized by law.”

The questions argued in this case are the same as those in the case of the Fire Department against Noble and others, decided at the present term.
This case was argued sometime after that against Noble, but we see no reason' to depart from the conclusions to which we arrived in that case and we refer to the opinion delivered in that case for our reasons for the decision made herein.
Judgment affirmed.
