The State of Louisiana, through the Department of Transportation and Development (hereinafter “DOTD”), appeals a trial court’s judgment which found the DOTD sixty percent at fault and assessed damages for a defective condition of a roadway shoulder. The vehicular accident killed Richard Baggett, the driver, and 1?,caused serious injuries to Christopher Cole and to Shane Rodriguez, his guest passengers.
