By a judgment of tbe Pike circuit court, entered at tbe November term, 1915, in this divorce action of Nannie Casebolt v. John Casebolt, tbe custody of tbeir daughter Blanche Casebolt, who was less than three years old, was awarded to her father.

Upon motion of tbe plaintiff, Nannie Casebolt, tbe judgment was modified on March 29th, 1916, so as to give tbe mother, Nannie Casebolt, tbe custody of her daughter Blanche until tbe further order of tbe court. *89Tbe modified judgment, however, gave tbe father the…
