Reversing'.

On June 8th, 1909, appellee, Smith Davis, was by a judgment of the Owen circuit court divorced from his wife, Stella Davis, who is the appellant in this proceeding. At the time' of the divorce the parties to the proceedings had two children, one of whom is now two and a half years .old and the other eight years old. The judgment awarded the custody of the children to their mother, Stella Davis, but provided that she should at all times keep them within the jurisdiction of the court and should at all reasonable times permit Smith…
