The plaintiff brought this suit against the defendant in'the circuit court of Jackson county to recover damages for injuries alleged to have *675been received by Mm through the negligence of defendant, by a shock caused by an electric current passing through his body while a passenger upon one of defendant’s cars. A trial was had and a judgment was rendered in favor of plaintiff for the sum of $8,500. After taking the proper preliminary steps, the defendant duly appealed the cause to this court.
