This controversy was submitted to the district court without pleadings upon an agreed statement of facts pursuant to section 4286, R. L. 1905. Plaintiff was, with the approval of the city attorney of Minneapolis, employed by defendant as an attorney, and rendered to defendant legal services of the. value of $650. The board of education of the city of Minneapolis was organized under chapter 157, p. 144, Sp. Laws 1878, and constitutes and is the public *168school authority of the municipality of the city of Minneapolis. The agreed statement of facts contained this:
