This Opinion addresses an issue of first impression in this Circuit: the constitutionality of provisions of the Prison Litigation Reform Act (“PLRA”) that cap attorneys’ fee awards to victorious prisoners.
On November 6, 2000, plaintiff Arnold Carbonell, an inmate at Green Haven Cor rectional Facility, and defendants, employees of the New York State Department of Correctional Services (“DOCS”), settled this § 1988.medical indifference action for $15,000, leaving the amount of attorneys’ fees for Court resolution.
