This is an action at law triable to a jury on an insurance policy issued by the defendant company on the life of Floyd F. O’Neal, by the widow of the insured, Katherine Louise O’Neal, against the defendant company and the sister of the insured, Valeria Gladys O’Neal.

The parties to this appeal occupied reverse relative positions in the lower court; they will be referred to hereinafter as they appeared below.
