This matter is before the court on defendant’s Motion for Summary Judgment (Doe. 83).

I. INTRODUCTION

Randall B. Godinet (“Godinet”), an American Samoan, was first employed by the defendant, Management and Training Corporation (“MTC”), at the Flint Hills Job Corps Center (“Flint Hills”) as a Residential Advis- or in January of 1992.
