OPINION ON STATE’S PETITION FOR DISCRETIONARY REVIEW

CAMPBELL, Justice.

Appellant was convicted by a jury of the offense of murder. V.T.C.A. Penal Code § 19.02(a)(1). 1 The court assessed punishment at twelve years confinement in the Texas Department of Corrections. The El Paso Court of Appeals reversed the conviction, holding that the evidence was insufficient and ordered an acquittal. Camacho v.
