This original action in prohibition challenges the jurisdiction of the respondent circuit judge to proceed under a petition filed, as authorized in Mo. R. S. A., Sec. 9359.3 (Laws Mo. 1949, p. 252, et seq.), in the circuit court of Linn County by the prosecuting attorney of that county. The above statutes here questioned, hereinafter referred to as the Act, became effective August 1, 1949, and provide for the detention and treatment of criminal sexn'al psychopaths. The case is'one of first impression in'this state.
