The appellant brought suit against the appellee to quiet title to certain described real estate. He claimed the land by virtue of a patent issued by the land office to 160 acres of land, which patent he contended embraced the land in dispute. The patent was issued to William F. Higgins on June 10, 1892, and noted thereon were the words: “Subject to the right of way of the A. T. & S. F. Ry.
