I. INTRODUCTION
Defendant’s motion to dismiss is in response to a complaint alleging that two cease and desist orders entered by the United States Postal Service (“USPS”) violated the principle of separation of powers, the first amendment and the exclusive jurisdiction of the Federal Trade Commission (“FTC”) and the Food and Drug Administration (“FDA”). Claiming that no adequate remedy at law exists, plaintiffs’ complaint requests declaratory judgment and injunctive relief.
