Patrick Murphy, the appellant, was indicted by the Grand Jury for Prince George’s County on October 13, 1942. The indictment contained three counts, the first charging him with the rape of one Margaret Laignell, the second charging an assault with the intent to rape, and the third, assault and battery, all on the 19th day of April, 1942. On April 14, 1944, he was arraigned and entered a plea of not guilty. On April 28, 1944, he was tried before a jury and was found guilty on the first count of the indictment.
