The questions presented upon this record, in the arguments before us, arise upon an instruction given on substantially the following facts in evidence before the jury:
Appellant operates a double track railway, running north and south, between Chicago and Evanston, for suburban service. The Chicago and Northwestern Bailway Company ■ also operates a like ‘railway, parallel with that of appellant, . and some 50 feet to the west of it.
