This was an action in case, in the City Court of East St. Louis, by appellee against appellant, to recover for a personal injury. Trial by jury. Verdict for appellee in the sum of §5,500. Remittitur of $1,500. Judgment on the verdict for $4,000.

The declaration is, in substance, that appellee was in the employ of the Baltimore & Ohio South-Western Railroad Company as a locomotive engineer, and required in the discharge of his duties to operate and run a certain switching engine of said company, in hauling freight cars into and out of the yards of the defendant at said city, and defendant was…
