MOORE, Justice.
This is an appeal from a summary judgment. Plaintiff, H. D. Merrell, Jr., filed suit against Robert A. Fanning and Harlan Harper, d/b/a Fanning & Harper, First Texas Savings Association of Dallas, John D. Flickinger, and Clarence Jones, for damages alleging that defendants entered into conspiracy to deprive him of his property by wrongfully causing an execution sale of a duplex owned by plaintiff. In the alternative, plaintiff sued each defendant individually, alleging that as a result of the conduct of each, he suffered the loss of title and possession of his property. Fanning…
