By two certain written agreements, one dated September 15, and the other November 2, 1885, the plaintiff agreed to manufacture a large quantity of engravings and lithographs for theatrical purposes, for the defendant and for his special use, to be taken and paid for during the *171theatrical season of 1885-86, and all of the work was to be completed and ready for delivery by the 15th day of December, 1885.
