OPINION
GILMAN, Circuit Judge.
Therma-Scan, Inc. (to be referred to as “TSI” solely for the sake of clarity), a Michigan corporation, sued Thermoscan, Inc., a Georgia corporation, alleging trademark infringement and unfair competition. Thermoscan subsequently filed a motion for summary judgment. During oral argument on Thermoscan’s motion, the parties purported to reach a settlement with the assistance of the district court.
