Plaintiffs Jerome and Lupe Dolenz brought this action against the United States under the Federal Tort Claims Act (FTCA), 28 U.S.C. §§ 2671-2680, for injuries sustained by Mr. Dolenz in an automobile accident with a government vehicle driven by a Department of Agriculture employee. Following a bench trial, the district court found in favor of plaintiffs on the question of liability and entered judgment in their favor.
