MEMORANDUM OPINION AND ORDER

HIGHSMITH, District Judge.

This action arises from Metropolitan Dade County Fire Department’s (“Fire Department”) rejection of Alan Andrew Peightal’s application for employment as a firefighter in October, 1983. In March, 1986, Peightal filed a racial discrimination charge with the Equal Employment Opportunity Commission (“EEOC”). The EEOC concluded that the Fire Department’s employment decision was not unlawful because it complied with the Commission’s affirmative action guidelines.
