Appeal from a judgment of the superior court for Walla Walla county, Brents, J., entered June 27, 1910, in favor of the plaintilf, after a trial before the court and a jury, in an action on contract.

The plaintiff commenced this action to recover from the defendant the purchase price of certain land in Walla Walla county, and the value of the improvements placed thereon by him, which land he went into the possession of under a .contract with the defendant for the purchase thereof. He claims the right to rescind the contract because *117of the failure of the defendant to convey to him the title to the land as agreed by the terms of the contract.
