Statement of the case by Q-keen, Judge : This was an action of ejectment brought in May, 1884, by Edward M. Oney against Loraine Stinson and E. Gf. Clen-denin in the circuit court of Mercer county. I will consider first the fourth assignment of error ir. the petition of the plaintiffs in error, the defendants in the court below.
