MEMORANDUM DECISION

I. INTRODUCTION

On August 29, 2006, Kerry Simms filed a “Motion to Dismiss Case and Order to Show Cause” (“Motion”). The Motion was filed by Kerry Simms (“Movant”), a creditor in the above-captioned case. 1 Frederick Simms, another creditor, also joined in the Motion to Dismiss.
