MEMORANDUM OF DECISION
LESLIE TCHAIKOVSKY, Bankruptcy Judge.
Sara L. Kistler, Acting United States Trustee, (the “UST”) moves to dismiss the above-captioned case as an abuse of the Bankruptcy Code pursuant to section 707(b)(3). 1 For the reasons stated below, the motion will be GRANTED.
BACKGROUND
John Pak (the “Debtor”), an individual whose debts are primarily consumer debts, filed a voluntary petition seeking relief under chapter 7 of the Bankruptcy Code on October 31, 2005.
