This action was instituted in tne Court of Common Pleas of Allen County for the pur pose of contesting the validity of the will of Mary Alice Woods.

The petition, filed on August 7,1952, alleges that the will was admitted to probate on February 11, 1952, in the Probate Court of Allen County. Ralph G. Fisher and Laura F. Roeder, executors of the estate of Mary Alice Woods, deceased, are named as defendants in the caption and body of the petition, together with Laura F. Roeder, Ralph G.
