This is an appeal by the defendant from a judgment of the circuit court, based upon the verdict of a jury, which finds him guilty of the crime of perjury. The indictment charges that the purported false testimony was given by the defendant March 31, 1938, while he was testifying as a witness in his own behalf in a criminal action in which he and three other indictees (V. Bailey, R. W. Blaine and V. D. McCauley) were accused of the crime of having broken the glass of a building which they did not own.
