MEMORANDUM OPINION AND ORDER

BABCOCK, District Judge.

In this interpleader action involving the proper disposition of oil and gas royalty payments, Defendants Floyd R. Hester and Carol B. Hester (collectively the “Hes-ters”) move to dismiss for failure to state a claim pursuant to Rule 12(b)(6). Defendant United States of America (“the government”) moves for default judgment, pursuant to Rule 55(b)(2), against Defendant the Aspen Group and summary judgment, pursuant to Rule 56, against the Hesters.
