[¥26] I respectfully dissent and would reverse the district court's ruling and dismiss the amended complaint. Having carefully considered the parties' briefs and oral arguments, I am persuaded that the county defendants' argumentation best captures the applicable law. As explained in more detail below, I would hold that the county defendants did not owe a duty to protect Daniel O'Brien from the intentional criminal acts of Samuel Graumann.
