This cause was decided by this court November 24, 1915, with the result that the judgment of the district court, awarding damages to appellee on account of the death of her husband, alleged to have been killed by the negligence of appellant, was reversed and judgment was rendered for appellant. That decision was based upon our finding that the evidence showed that the deceased was guilty of contributory negligence as a matter of law. 181 S. W. 545.
