W. V. Hollingsworth instituted this suit in the County Court of Grayson County, Texas, alleging that on the 1st day of April, 1901, he had five mules killed by an engine and cars belonging to defendant, and that the same were of the value of $800. Defendant answered by general denial, and that if plaintiff’s mules were killed he himself was guilty of contributory negligence proximately causing the injury, and specially pleaded that at the time the mules were killed chapter 128 of the Acts of the Begular Session of 1899 of the Legislature of the State of Texas were…
