DUFFY, Justice:

This certification proceeding arises from an action filed in the Superior Court by the Attorney General and the Board of Elections, Department of Elections for New Castle County (plaintiffs), seeking- a declaratory judgment concerning defendant’s eligibility to hold the Office of President of New Castle County Council. 1 The following questions of law were certified and accepted by this Court:
