The appellant, the receiver for the Associated Packing Company, originally brought an action in the district court of Polk county, Iowa, against all the appellees and others, in which the receiver attempted to join in one action an action in equity, to secure an assessment against the subscribers to the capital stock of the Associated Packing Company, and actions at law against each of said appellees, asking personal judgments against each of them for the amount claimed to be due on said assessment.
