OPINION
FRYE, District Judge:
The matters before the court are the following motions:(1) the motion (# 47) of defendant, Surety Life Insurance Company (Surety), for summary judgment or partial summary judgment against plaintiff, Elizabeth Di-Carlo;(2) the motion (#78) of Surety to strike portions of DiCarlo’s affidavit and exhibits in opposition to the motion for summary judgment.
