ORDER GRANTING DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

Defendant has moved the Court to enter summary judgment in these proceedings and to dismiss plaintiffs complaint. The Court having reviewed the arguments presented by the parties as well as the evidence submitted in support thereof hereby rules as follows.
