The plaintiff in this action was formerly employed by the defendant as a chauffeur, operating an oil tank truck from the defendant’s bulk storage' plant, located in Mount Vernon, N. Y. This truck was one of a number owned by the defendant and was utilized to supply retail distributors and large consumers in Westchester, Bronx and New York counties in the State of New York, with the products of the defendant.
