Affirming.

About 12 o’clock on the night of Derby day, 1922, appellee Garr boarded a ear of appellant, Louisville & Interurban Kailway Company, at its station, in the city of Louisville, to be carried, as a passenger, to Lagrange, and while in the car and only a short time, after it left 'the station he was struck and injured by a colored boy, also a passenger, and this suit against the company to recover damages, resulted.
