Dawson, J.:

This is an appeal from a judgment forfeiting an automobile which had been used in the unlawful transportation of intoxicating liquor.

It appears that on January 14, 1931, one J. H. Starnes, of Colby, a dealer in automobiles, sold the vehicle in question to H. J. Bank-son, who gave his note and a chattel mortgage on the automobile to secure the purchase price of $615.96, which was to be paid in monthly installments.
