— Affirming in part and reversing in part.

The Farmers’ Bank of Wickliffe, after conducting tire banking business from 1902 to 1908, made a deed of assignment to tbe appellant, J. B. Wickliffe, conveying to him as trustee for tbe benefit of its creditors, all its property of -whatsoever kind. Its capital stock was fifteen thousand dollars, in shares of one hundred dollars each, all subscribed and paid for.
