OPINION AND ORDER
LAFFITTE, District Judge.
Pending before the Court is the issue of how and in what order the legal theories presented in this case will be tried. This case 1 arises out of the construction of a project known as the “Mayaguez Composting Facility.” In 1987 the Puerto Rico Aqueduct and Sewer Authority (“PRASA”) contracted the engineering and architecture firm of Le-brón Associates (“Lebrón”) to design the facility.
