Pro se petitioner Arturo Reynoso (“Rey-noso”), currently incarcerated at Clinton *587Correctional Facility in New York, filed the instant motion (“Motion”) pursuant to Federal Rule of Civil Procedure 60(b) (“Rule 60(b)”) to vacate his judgment of conviction. (Dkt. No. 25.) Reynoso was convicted in New York State Supreme Court, Bronx County (“Trial Court”) of murder in the second degree in violation of New York Penal Law (“NYPL”) Section 125.25(1).
