On February 20, 1960 the minor Manuel Enrique Resto sustained an accident. The trial court found that:

“On February 20, 1960, Manuel Enrique Resto had been shopping with his parents at the store of Enrique Montes. His father Manuel Resto Negrón gave him two gallons of kerosene inside a sack to take home. Manuel Enrique Resto and a younger brother headed towards their home, along highway 149 from Villalba to Cíales, taking the left walk.
